Terms of Service

1. Acceptance of Terms

By accessing or using Rootz & Branches LLC ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

We reserve the right to update these terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms.

2. Eligibility

You must be at least 13 years of age to use Rootz & Branches LLC. Users between the ages of 13 and 17 must have parental or guardian consent. Members under 18 are subject to additional parental controls including content approval by a household admin before any uploads become visible.

By using the Service, you represent and warrant that you meet these eligibility requirements.

3. Account Registration

To access the Service you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to provide accurate and complete information when registering and to update your information as needed to keep it accurate.

4. Acceptable Use

You agree not to use the Service to:

• Upload or share content that is illegal, harmful, threatening, abusive, or offensive
• Impersonate any person or entity
• Upload content that infringes on intellectual property rights
• Attempt to gain unauthorized access to any part of the Service
• Use the Service for any commercial purpose without written consent
• Upload content that violates the privacy of others

5. Your Content

You retain ownership of all content you upload to Rootz & Branches LLC. By uploading content, you grant us a limited license to store, display and share your content within the Service as directed by you.

We do not claim ownership of your family's memories, photos, voice recordings or any other content you upload.

6. Subscriptions & Billing

Rootz & Branches LLC offers three plans:

• Free — 2GB storage, voice memories and photos, family tree view only, basic family feed
• Family — $6.99/mo or $69.99/yr. 10GB shared storage, voice, photos and video, full family tree, export and download memories, expandable storage
• Legacy — $14.99/mo or $149.99/yr. 50GB shared storage, everything in Family, Legacy Vault, priority support, early access to new features, expandable storage

Paid plans are billed in advance on a monthly or annual basis. You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period. We do not provide refunds for partial billing periods.

7. Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service you consent to the practices described in our Privacy Policy.

We take your family's privacy seriously. We never sell your data to third parties. Your family's memories stay in your family.

8. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms of Service. You may also delete your account at any time through the Settings menu.

Upon termination you can request a full export of your data within 30 days.

9. Legacy Vault

The Legacy Vault is a feature available on the Legacy plan that allows you to store personal photos, voice recordings, letters and documents to be released to a designated recipient after your passing. All vault contents are encrypted using AES-256 encryption and are completely private — only visible to you while you are living.

Release Process:

The vault release process requires the following steps:

• The designated beneficiary must upload an official government-issued death certificate
• Our admin team will verify the certificate within 2 business days
• A mandatory 30-day grace period begins upon verification
• After the grace period the vault is released to the designated beneficiary
• The death certificate is permanently deleted immediately after vault release

Death Certificate Requirements:

• Must be an official government-issued death certificate
• Must clearly show the full legal name of the deceased
• Must include date of death and issuing authority
• International certificates are accepted

By using the Legacy Vault you acknowledge and agree that:

• Rootz & Branches LLC is not a legal executor and the Legacy Vault is not a legally binding document or will
• Rootz & Branches LLC not responsible for disputes between family members over vault access or designated recipients
• The designated recipient is the only person authorized to request vault release and must provide a valid death certificate
• The 30-day grace period is mandatory and cannot be waived
• Your beneficiary designation is final and binding — it cannot be overridden by other family members or third parties
• Any party seeking to legally challenge a vault release must obtain a court order prior to the scheduled release date
• Death certificates are handled with strict confidentiality and permanently deleted after vault release
• We are not liable for any claims arising from the release or non-release of vault contents

10. Funeral Planner

The Funeral Plan is a feature available on the Legacy plan that allows you to pre-plan your funeral arrangements and share them securely with a designated recipient and funeral home.

By using the Funeral Plan you acknowledge and agree that:

• Rootz & Branches LLC is not a funeral home and does not provide funeral services
• The Funeral Plan is for informational purposes only and is not a legally binding document or contract with any funeral home
• We are not responsible for whether a funeral home honors the preferences documented in your plan
• Secure funeral home links expire after 72 hours and must be regenerated after expiry
• Your designated recipient has immediate access to your plan at any time
• We are not liable for any claims arising from the use or non-use of the Funeral Plan feature

11. Disclaimer

The Service is provided "as is" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.

To the maximum extent permitted by law, Rootz & Branches LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.
